Terms of Service
These terms are an agreement between you and LocalPilot, Inc. (LocalPilot, we, us). They apply when you visit a website hosted by LocalPilot, book an experience through it, or use LocalPilot to run your business. By using the service you agree to these terms.
1. What LocalPilot is
LocalPilot is a booking platform. We give boat, fishing, and tour operators (operators) a hosted website where guests can see experiences, choose a date, and pay. We are not a tour company. We do not own boats, employ captains, or run trips.
2. Roles: the operator delivers the trip
Every experience listed on an operator’s website is offered and delivered by that operator. The operator is the merchant of record for the trip, sets the price, decides who may come aboard, holds the required licenses and insurance, and is responsible for safety, equipment, and the quality of the experience. Your booking is a contract between you and the operator. LocalPilot provides the software and collects a platform fee from each booking, but we are not a party to that contract and are not liable for what happens on the water.
3. Booking and payment
Payments are processed by Stripe. When you pay, your card is charged for the trip and the funds are routed to the operator, less LocalPilot’s platform fee. LocalPilot does not store your full card number. Prices are shown in the operator’s currency and include what the operator has chosen to include; taxes, gratuities, and fuel surcharges are the operator’s responsibility to disclose. A booking is confirmed only when you receive a confirmation email. Cancellations and refunds follow our Refund & Cancellation Policy and the operator’s stated policy.
4. Guest accounts
Guest accounts are passwordless. We send a one-time code to your email address when you book or sign in. You are responsible for keeping access to that mailbox secure, and for anything done through your account. Give us accurate contact details so operators can reach you about your trip.
5. Your conduct
You agree to follow the operator’s safety instructions, arrive on time, and be honest about the number of guests and any medical or accessibility needs that affect a trip. You may not use the service to make fraudulent bookings, scrape or copy operator content, probe or disrupt our systems, or send unsolicited messages to operators or other guests.
6. Operator terms
If you use LocalPilot to run a business, you confirm that you are authorized to act for that business, that you hold every license, permit, and insurance policy required to operate, and that the content you publish is accurate and yours to use. You accept Stripe’s Connected Account Agreement when you connect payments. You agree that LocalPilot may deduct its platform fee (currently 4 percent of each booking) before funds reach your account, and that you are responsible for taxes on your sales. You must honor the cancellation policy shown to guests at checkout.
7. Email
We send transactional email you cannot opt out of while you have a booking or account: codes, confirmations, reminders, and receipts. Operators may also send marketing email through LocalPilot; every such message includes an unsubscribe link and we honor it. See the Privacy Policy for details.
8. Content and intellectual property
LocalPilot owns the platform, its software, and its design. Operators own the photos, text, and other content they publish and grant us a license to host and display it. You may not copy the platform or resell access to it.
9. Disclaimers and limitation of liability
The service is provided as is. To the fullest extent permitted by law, LocalPilot is not liable for injuries, losses, delays, or damages arising from a trip, from an operator’s acts or omissions, from weather, or from your use of the service. Our total liability to you for any claim related to the service is limited to the platform fee we received on the booking in question, or one hundred US dollars if no fee applies. Some states do not allow these limits, so they may not apply to you.
10. Termination
You may stop using the service at any time and can ask us to delete your account. We may suspend or close accounts that break these terms, create risk for guests or operators, or remain unpaid.
11. Governing law and disputes
These terms are governed by the laws of the State of [STATE] (placeholder to be completed before publication) and the federal laws of the United States, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in the State of [STATE], and you consent to their jurisdiction. The service is offered in the United States only.
12. Changes
We may update these terms. When we do, we will change the effective date above and, for material changes, notify account holders by email. Continued use after a change means you accept the new terms.
